Please fill out this highly secure form as completely as you can. Many sections only apply to some families, so skip anything that doesn’t apply to you. Nothing you enter here is sent anywhere automatically — see below for how to deliver it to your lawyer once you are done.

We encourage you to periodically click the green button that says Save for Later to store your progress in your browser’s memory. It will last there between sessions and even shutdowns, as long as you do not clear your browser’s cache. Your document details

Your Living Will specifics

The Living Will document will only be relevant in the event that:

  1. you are unable to communicate in any manner, or lack the capacity to make yourself reliably understood, and also

  2. you have an incurable or irreversible mental or physical condition with no reasonable expectation of a meaningful recovery, such that medical intervention is required to keep you alive but will not restore you to capacity.

Note
These directives are for your healthcare proxy, not for physicians. Doctors will be asking your proxy to interpret these directives and convey your wishes.

In such a situation, what values or principles should guide decisions about your continued healthcare? Here are some examples, but please try to articulate your own:

  • I believe that wisdom is possible at all phases of living and dying, and I do not wish for my life to be cut short, unless and until I have had no brain function for 24 hours.

  • My primary aim is to avoid suffering. Medical care should be calculated to diminish pain, both physical and mental, even if this may hasten my passing.

  • I do not wish to languish without joy in my surroundings, loved ones, food, or art.

How would you define the point at which you will have reach an undesirable quality of life, such that you might wish to decline some types of medical care? (Check all that apply)

Check the procedures and treatments that you DO NOT want in the event that you are unable to make or communicate decisions IF the administration of such treatments will not restore you to health or capacity.

Any procedures and treatments you will wish to ensure are performed

Any special conditions or qualifications for treatments and procedures to be withheld or withdrawn, such as…

I wish for these procedures or treatments ONLY in the event that their temporary administration will facilitate my return to a state in which they are no longer necessary. I want these procedures or treatments to be aborted if they show no signs of improving my condition within a week (7 days) of their initiation. I do NOT want antibiotics even if the doctors say it will reduce suffering.

Where would you prefer to live out your final days, if it is practicable for your loved ones to appropriately move and care for you in the desired environment? (Rank the following)

  1. Home
  2. Hospice
  3. Hospital
  4. Nursing or Rehabilitation Facility

Any special notes regarding the treatment of your condition when you are unable to carry it out yourself. Use this spot to reiterate any rejected end-of-life settings deleted from your Preferred place of final care.

Healthcare and legal agents

These are four separate roles, and your choice for one does not carry over to the others — you may name the same person for all of them, or different people for each:

  • A healthcare proxy agent makes medical decisions on your behalf when you cannot make them personally.

  • A healthcare informed individual has no decision-making power, but is authorized to see your medical records and speak with your doctors.

  • A power of attorney agent manages your financial and legal affairs.

  • A trustee manages assets placed in a trust for a beneficiary, which is a narrower job than a general power of attorney agent.

Row order for POA agents, trustees, and remains agents is priority order — the first row is who is asked first, with later rows only stepping in if an earlier one is unable or unwilling to serve.

Healthcare proxy agents

People who will serve as healthcare proxy agents. Their relationship, phone number, email, and home address are required (and auto-filled if already on file elsewhere in this form).

Healthcare informed individuals

Additional people you authorize to speak to your doctors or access your medical records. Their relationship, phone number, email, and home address are required.

Power of attorney agents

Your power of attorney agents. Their relationship, phone number, email, and home address are required (and auto-filled if already on file elsewhere in this form). Row order is priority — drag rows to reorder them, with your primary agent first.

Your Last Will and Testament

Executors

Your primary executor is first and your successor executor is second. Both rows are required.

For the fields in this section, be sure to include any information that will aid in locating documents such as titles, deeds, and certificates.

Distribution

Estate portioning

Total: 0%

This section is for percentage shares of your residual estate — everything left over after specific gifts, debts, and expenses — not specific items. For a specific item (a car, a piece of jewelry, an heirloom), use Personalty (possessions) distribution below instead.

The percentages across every row here must add up to exactly 100%; the running total shown next to the section heading turns green once they do. A sole recipient should receive 100%.

Anyone you wish to leave a portion of your estate to.

%

Personalty (possessions) distribution

Every recipient here (general or item-specific, primary or secondary) may be an individual person or a group — check "This is a group" and name it descriptively (e.g. "my cousins on my father’s side") instead of picking an individual. A group is not linked to any specific person record; it’s just a name, and optionally a phone/email for whoever should be contacted on the group’s behalf.

Start general, then get specific. You may start with something like all of my possessions or everything at the lake house. (Any category description will be assumed to have exceptions listed in other records.)

Also note that you may leave any item or category of items to any individual or category of individuals. Create a group of recipients using + Add new in the recipient selector, then creating a group label like my cousins on my father’s side or my sister Jeanie’s children and check "This is a group".

Be as specific, detailed, and colorful as you wish, such as "my grandmother’s diamond ring" or "the 1972 Fender Stratocaster I played in my first band" or "the '62 Corvette my dad restored and left to me" or even "because she always admired it, the white piano in my living room".

Your trust details

Because you can also put your assets into trusts using the language of your will, you will have to identify a primary and a successor Trustee who will manage any assets placed in trust for a beneficiary.

Trustees

Your trustees. Their relationship, phone number, email, and home address are required (and auto-filled if already on file elsewhere in this form). Row order is priority — drag rows to reorder them, with your primary trustee first.

Other wishes

Guardianship wishes

A court gives significant weight to a documented guardianship preference, but it is not automatically binding — a court can decline to follow it if it finds the named guardian unfit, or if circumstances have changed by the time it matters. Naming a backup gives a court a fallback if a preferred guardian is unable or unwilling to serve, though this list is only as good as how current it is, so it’s worth revisiting after any major change in the family.

A guardian can be an individual, a couple (add one row per person, with matching Conditions), or a group — select + Add new and check "This is a group" the same way as for a personalty recipient.

Use Conditions for anything that should switch a court from this row to the next — for example "only while still married to Pat" or "only until the kids have all turned 10". Leave it blank for an unconditional choice.

Whom you would like a court to appoint as your minor children’s guardian, ranked in priority order — drag rows to reorder, with the most-preferred choice first.

e.g. "only while still married to Pat" or "only until the kids have all turned 10"

Do any of your children have special needs? If so, please describe their needs, and the ideal resources required to accommodate those needs.

Is there anyone whom you think ought to be excluded from acting as guardian for your minor children? Please give their full name, their relationship to you, and the reasons you believe them to be unsuitable.

This information will be memorialized in a confidential letter to any judge who is ever called upon to make a decision about the guardianship of your minor children, and will be opened only in the event that the named individual attempts to gain legal custody.

I wish for my skin and other organs to be used for:

Agents for distribution of remains

Who you wish to manage your remains. Their relationship, phone number, email, and home address are required (and auto-filled if already on file elsewhere in this form). Row order is priority — drag rows to reorder them, with your primary agent first.

Describe any wishes you want to convey to those responsible for your remains. Include anyone you wish to exclude from managing these rites or attending events.

Form integrity and feedback

If this form constrained you in any way that prevented you from accurately conveying your wishes, please express any details here.

Please let us know if anything in this form did not work properly or was frustrating or confusing. We will use this feedback to improve the form for future users.
